These Booking and Rental Terms and Conditions govern the booking and rental of bicycles and accessories offered by Monkey Bikes Team | bikerentmallorca (hereinafter referred to as “Monkey Bikes Team”, “the Company” or “the Establishment”).
Making a booking and accepting these terms by ticking the corresponding checkbox during the booking process means that the customer has read, understood and accepted these terms and conditions.
1. Booking and Contracting
The booking will be considered confirmed once the booking process has been completed correctly and the payment or deposit required under the conditions of the selected rate has been made.
The customer must provide accurate and up-to-date information during the booking process, including their contact details and any information required to provide the service.
The booking is personal and is linked to the customer or customers specified during the booking process.
The availability of bicycles and accessories is subject to confirmation and availability at the time the booking is made.
2. Prices and Payments
The applicable prices will be those indicated at the time the booking is made.
Any additional service, accessory, insurance, repair, replacement or expense arising from the rental may incur an additional charge in accordance with the applicable rates.
Where applicable, any outstanding amounts must be paid within the deadlines and using the payment methods established during the booking process or communicated by Monkey Bikes Team.
The customer shall be responsible for any additional amounts arising from damage, loss, theft, late return or improper use of the equipment, in accordance with these terms and conditions.
3. Booking Cancellation
The cancellation conditions are as follows:
- Cancellation at least 30 days in advance: full refund of the deposit paid for the booking.
- Cancellation less than 30 days in advance: the booking deposit is non-refundable.
The date and time used to determine the cancellation period shall be the date and time on which the cancellation request is effectively received by Monkey Bikes Team.
Cancellation conditions may vary where the customer has booked a specific rate with different conditions. In such cases, the specific conditions displayed during the booking process shall prevail.
4. Booking Modification
The customer may request modifications to their booking, such as changes to the dates, duration, number of bicycles or type of bicycle, subject to availability.
Modification requests must be made at least 24 hours in advance, unless Monkey Bikes Team expressly agrees to a different period.
Any modification is subject to availability and may result in a change to the booking price.
If the modification results in an increase in price, the customer must pay the corresponding difference.
If the modification results in a reduction in price, the resulting amount will be handled in accordance with the cancellation and modification conditions applicable to the booking.
Modifying a booking does not automatically mean that the cancellation conditions of a new booking will apply.
5. No-Show
If the customer does not appear to collect the bicycle on the agreed date and has not previously communicated a cancellation or modification of the booking, the booking may be considered a no-show.
In the event of a no-show, the amount already paid may be considered non-refundable.
Where an outstanding amount remains payable, Monkey Bikes Team may apply the financial conditions applicable to the booking.
6. Bicycle Collection
To collect the bicycle, the customer must present:
- A valid ID card, passport or other valid identification document.
- A valid credit card for the corresponding security deposit or pre-authorisation.
Before the rental begins, the bicycle and accessories will be inspected by Monkey Bikes Team and the customer.
The customer must report, before starting the rental, any damage, scratches or defects they observe that have not previously been identified.
Once the rental has started, the customer will be deemed to have accepted the condition of the bicycle and accessories, except for defects that were not reasonably visible during the initial inspection.
7. Physical Condition and Fitness to Ride
The customer declares that they are in adequate physical and health condition to use the rented bicycle and have the necessary ability to ride it.
The customer must adapt their riding to their own abilities, the characteristics of the bicycle, weather conditions, road conditions and traffic.
The customer is responsible for using the bicycle prudently and complying at all times with the applicable traffic regulations.
8. Responsible Use of the Equipment
The customer undertakes to use the bicycle and any additional equipment responsibly and in accordance with its intended purpose.
The following are prohibited:
- Lending or transferring the bicycle to third parties without the authorisation of Monkey Bikes Team.
- Adding unauthorised components or accessories.
- Dismantling, modifying or tampering with the bicycle.
- Carrying out repairs or modifications without authorisation.
- Using the bicycle in areas or on terrain for which it is not suitable.
- Using the bicycle negligently or contrary to the instructions provided.
- Using the bicycle for activities for which it was not designed.
The rented equipment may only be used by the customer named in the booking or by a person expressly authorised by Monkey Bikes Team.
9. Damage, Defects and Loss of Equipment
The customer shall be responsible for any damage, total or partial breakage, loss or deterioration of the rented equipment occurring during the rental period when caused by improper, negligent or non-compliant use.
In the event of damage, breakage, loss or improper use, Monkey Bikes Team may charge the customer the corresponding repair or replacement cost.
Repair or replacement costs may be determined by reference to the official prices of bicycle, component and accessory suppliers in Spain.
As a reference:
Partial damage or scratches to the frame, fork and/or components:
€75 per damaged section or component.
Where the damage requires specialised repair or replacement of a component, the actual corresponding cost may be charged.
10. Theft or Loss
The customer shall be responsible for taking reasonable and necessary measures to prevent theft or loss of the bicycle and accessories.
In the event of theft or loss of rented equipment, the customer must notify Monkey Bikes Team immediately and, where applicable, file a corresponding report with the authorities.
Where the theft or loss is not covered by the insurance purchased, the customer must pay the corresponding value of the bicycle, accessory or affected item.
Having travel insurance or personal insurance does not remove the customer's obligation to be liable to Monkey Bikes Team under these terms and conditions. Monkey Bikes Team may provide an invoice or supporting documentation so that the customer can subsequently claim the amount from their insurer.
11. Optional Insurance
The customer may purchase additional daily insurance when making the booking or before the rental begins, subject to availability.
The current rates are:
- E-bikes and gravel: €6 / day.
- High-end road bikes: €8 / day.
11.1 Accidental Damage
The insurance covers accidental damage in accordance with its conditions, subject to a deductible of:
- €50 per claim.
- €75 for Trek Madone bicycles.
11.2 Theft
In the event of theft covered by the insurance, the deductible shall be 20% of the value of the bicycle, subject to the following maximum amounts:
- E-bikes and gravel: maximum €600.
- Road bikes: maximum €800.
Theft coverage is subject to compliance with the security measures established by Monkey Bikes Team and the terms and conditions of the insurance.
11.3 Exclusions
The insurance does not cover damage or theft resulting from negligence, improper use or failure to comply with these terms and conditions.
Among other situations, the following are excluded:
- Leaving the bicycle without the required security measures.
- Lending or transferring the bicycle to third parties.
- Using the bicycle improperly.
- Tampering with or modifying the bicycle without authorisation.
- Any other situation expressly excluded under the insurance terms and conditions.
If the customer does not purchase the optional insurance, they shall be responsible for the full corresponding repair or replacement cost in the event of damage, loss or theft for which they are liable.
12. Security Deposit
At the time of collecting the bicycle, a hold or pre-authorisation on the credit card will be made as security.
This hold does not constitute an actual charge unless it subsequently becomes necessary to use all or part of the security deposit to cover amounts owed by the customer.
The security deposit amounts are:
- E-bikes and gravel: €250.
- High-end road bikes: €500.
Once the rental has ended and the bicycle and accessories have been checked and confirmed to have been returned correctly, Monkey Bikes Team will request or process the release of the corresponding hold.
The actual release period may depend on the card issuer and the relevant financial institution.
In the event of damage, loss, theft, additional charges or other amounts payable by the customer, Monkey Bikes Team may use the security deposit in accordance with these terms and conditions.
13. Return of Equipment
The customer undertakes to return the bicycle and any additional equipment in the same condition in which they were provided, except for normal wear resulting from proper use and ordinary dirt or cleaning.
The bicycle must be returned on the date, at the time and at the location agreed with Monkey Bikes Team.
The return deadline may vary depending on the season. The exact return time will be communicated or agreed with the customer at the time of collection.
14. Late Return
Late return of the equipment may result in a charge of:
€100 per day of delay.
Where the delay is less than one day, Monkey Bikes Team may apply the corresponding rates or costs proportionally when necessary due to the impact on another booking.
The customer must notify Monkey Bikes Team as soon as possible of any circumstances preventing them from returning the equipment at the agreed time.
15. Extension of the Rental Period
The customer may request an extension of the rental period with at least 24 hours' notice.
The extension is subject to availability and acceptance by Monkey Bikes Team.
Additional rental days will be charged according to the rates in force at the time the extension is requested.
Keeping the bicycle beyond the contracted rental period without prior authorisation does not constitute a valid extension of the booking.
16. Early Return
Returning the bicycle before the end date of the booking does not entitle the customer to a refund.
The customer must pay 100% of the booking amount, in accordance with the applicable conditions.
17. Spare Inner Tube — Road Bikes
Each road bike is provided with an additional inner tube located in the saddle bag.
The inner tube may be used by the customer in the event of a puncture.
The use of the inner tube will incur a charge of:
€7 per inner tube used.
The customer is not required to return the used inner tube or the saddle bag containing it. The charge will only apply when the inner tube has been used.
E-bikes and gravel bikes do not include an additional inner tube in the saddle bag.
18. Accidents, Third-Party Damage and Liability
The customer acknowledges that cycling involves certain inherent risks, including falls, accidents, adverse weather conditions, traffic, obstacles, road conditions and actions by third parties.
The customer shall be responsible for riding prudently and in accordance with the applicable regulations.
Monkey Bikes Team shall not be liable for accidents, injuries or damage suffered by the customer resulting from the use of the bicycle where these are caused by the customer's own riding, negligence, failure to follow instructions or circumstances beyond the reasonable control of Monkey Bikes Team.
The customer shall also be responsible for any damage caused to third parties or their property as a result of their riding or improper use of the bicycle.
19. Personal Belongings
Monkey Bikes Team shall not be liable for the loss, theft or damage of the customer's personal belongings during the rental period, except where legally required.
The customer shall be responsible for safeguarding their belongings while using the bicycle.
20. Mechanical Breakdowns or Problems
In the event of a breakdown or mechanical problem during the rental, the customer must contact Monkey Bikes Team as soon as possible.
The customer must not carry out repairs, modifications or mechanical interventions that could cause additional damage without prior authorisation.
Where the breakdown is caused by a mechanical defect not attributable to the customer, Monkey Bikes Team will endeavour to provide a reasonable solution according to the circumstances and availability.
21. Weather Conditions
Weather conditions do not automatically entitle the customer to free cancellation or a refund of a booking.
Where exceptional weather or safety circumstances make the provision of the service reasonably inadvisable or impossible, Monkey Bikes Team may contact the customer to seek an alternative solution.
22. Cancellation by Monkey Bikes Team
Monkey Bikes Team may cancel or modify a booking where exceptional circumstances prevent the service from being provided safely or appropriately.
Where the cancellation is attributable to Monkey Bikes Team and no reasonable alternative is available, the customer shall be entitled to a refund of the amount corresponding to the service not provided, without prejudice to any rights they may have under applicable law.
23. Force Majeure
Monkey Bikes Team shall not be liable for failures or delays resulting from circumstances beyond its reasonable control, including, but not limited to, extreme weather events, natural disasters, administrative restrictions, serious accidents, conflicts, strikes, public health emergencies or other force majeure circumstances.
In such cases, Monkey Bikes Team will endeavour to inform the customer and seek a reasonable solution taking the circumstances into account.
24. Regulations and Safety
The customer undertakes to comply at all times with the legislation and regulations applicable to cycling.
The customer must use the safety equipment provided or required and follow the usage instructions provided by Monkey Bikes Team.
25. Data Protection
Personal data provided by the customer during the booking process will be processed in accordance with the Privacy Policy of Monkey Bikes Team.
The data may be used to manage the booking, provide the service, send communications related to the rental, manage payments and security deposits, and comply with applicable legal obligations.
26. Acceptance of the Terms and Conditions
During the booking process, the customer must expressly confirm that they have read and accepted these Booking and Rental Terms and Conditions.
Acceptance of these terms and conditions is required to complete the booking.
The version of the terms and conditions applicable shall be the version that was in force and available to the customer at the time the booking was made, unless a subsequent modification is legally applicable.
27. Applicable Law and Dispute Resolution
These terms and conditions shall be governed by the applicable legislation.
In the event of a dispute, the parties shall endeavour to resolve the matter amicably before resorting to the courts.
